Brattleboro man gets six months in jail for five DUIs, other charges

Michael Nauceder, a 31-year-old man from Brattleboro, pleaded guilty to multiple charges, including driving under the influence on five occasions since 2020. At a hearing in Windham Superior Court, he received a sentence of three to seven years, with all but six months and 41 days suspended. Nauceder is already credited for the 41 days served.
His guilty pleas included instances of driving under the influence of both alcohol and drugs, resisting lawful arrest, possessing cocaine and fentanyl, violating release conditions, and driving on a suspended license. Notably, he admitted to pointing a knife at a police officer during a September 2023 incident. Deputy State's Attorney David Gartenstein expressed concerns about probation but noted the importance of "intensive programming" in addressing Nauceder's significant history of offenses.
Upon his release, Nauceder will be placed under the supervision of a DUI court for four years, and he will continue to be monitored by the Department of Corrections. His defense attorney, Nader Hashim, highlighted Nauceder's progress and expressed optimism about the support structure related to the DUI docket aiding his rehabilitation.
Judge John Treadwell also commented on the plea deal, indicating that it is an appropriate response to Nauceder's issues with substance abuse. He emphasized the importance of providing the necessary supervision to ensure a positive outcome for Nauceder moving forward.
The court's decision seeks to balance accountability for Nauceder's actions while also addressing the underlying substance use disorder contributing to his behavior.
