This ruling prohibits police forces from complying with ICE detainer requests, resulting in the release of dangerous undocumented immigrants who may commit crimes upon their release.

Fattman highlighted that a number of serious offenses involving released undocumented immigrants have occurred, including child rape and drug trafficking. These incidents emphasize the broader implications of the Lunn ruling, which he argues is not an isolated issue, stating, "these cases are happening across the commonwealth." The Senator is particularly concerned about the risk to public safety and the challenges faced by law enforcement under the current legal framework.

Additionally, Fattman criticized the Massachusetts "Right to Shelter" law, which has led to significant expenditures on migrant shelters since 2021, reportedly costing taxpayers over $3 billion. He claims that whistleblowers have reported abuses within this system, pointing to serious crimes that have occurred in state-funded shelters. A public records request revealed extensive documentation of violence and crime associated with individuals living in these shelters.

Fattman holds Governor Maura Healey and the Democratic-led legislature accountable for the situation, suggesting that a large number of asylum cases are ultimately denied, which undermines the argument that these individuals will contribute positively to society. He expressed frustration with taxpayer money being spent on a predominantly non-resident population, describing it as "lighting money on fire."

In response to these challenges, Fattman has proposed the "Shield Act," aimed at overturning the Lunn decision to enable local law enforcement to collaborate with ICE. He believes that the current climate has reached a tipping point, leading to growing demands for change from constituents, particularly in areas that lean politically conservative or moderate.
