New class action lawsuit accuses Las Vegas city marshals of 'unlawful arrests'

A class action lawsuit has been filed against the City of Las Vegas and its peace officers, alleging unlawful arrests conducted outside their legal authority. The lawsuit, lodged in US District Court, claims that city marshals have engaged in a systematic pattern of unconstitutional behavior.

The 16-page complaint, brought forward by attorney Adam Breeden on behalf of Derek Myers, details an incident from January 9, where Myers was pulled over by marshals on I-11 for alleged speeding and following too closely. It asserts that the marshals unlawfully searched both Myers and his vehicle without consent or a warrant, conducted an improper DUI test, and subsequently arrested him.

Myers spent 17 hours in jail before being released, with no criminal charges filed against him. The lawsuit argues that he represents "hundreds if not thousands of victims" of a rogue agency operating outside its prescribed jurisdiction.

The complaint seeks over $1 million in damages for battery, false arrest, and violations of Myers’ 4th and 14th Amendment rights concerning unlawful searches and false imprisonment. This highlights significant concerns regarding the conduct of law enforcement in Las Vegas.

As of now, FOX5 has contacted the city for comments on the allegations but has not yet received a response.
