Alberto Stasi non è un uomo libero nel senso comunemente inteso. Ma è un uomo condannato in via definitiva a sedici anni per omicidio che dopo dieci anni e sei mesi di carcere ha chiesto e ottenuto, con il parere favorevole della Procura generale di Milano, l’autorizzazione a fruire dell’affidamento in prova ai servizi sociali, una misura alternativa al carcere concessa quando il detenuto ha mostrato rispetto delle regole, ha intrapreso un percorso di reinserimento sociale e la pena residua non è superiore a quattro anni. Requisiti pienamente assolti da Alberto Stasi, il quale lavora al di fuori del carcere già da alcuni anni, ha un residuo pena di poco più di due anni e ha sempre rispettato pienamente ogni regola prevista dall’Ordinamento Penitenziario, al punto che il Tribunale di Sorveglianza, nel disporre l’affidamento ai servizi sociali, non ha previsto alcun obbligo di svolgere attività di volontariato, come invece spesso accade. Questa misura non ha nulla a che vedere con l’istanza di revisione che, unitamente o no a una richiesta di sospensione della pena, verrà depositata. È una misura che sarebbe stata disposta anche se non ci fosse alcun altro indagato per l’omicidio di Chiara Poggi. Ma il fatto che avvenga ora, mentre poteva avvenire anche mesi fa, mi fa pensare che questo sia un primo passo verso la libertà provvisoria che potrebbe arrivare con l’accoglimento di una istanza di sospensione della pena, e verso la libertà definitiva che potrebbe arrivare con l’accoglimento della domanda di revisione.
