Lilly Téllez 2h

Lilly Téllez responded to Citlalli Hernández that the Metropolitan Area of Mexico Valley Planning Program was not a law, but rather a draft initiative. According to Téllez, its page 174 proposed that, after a first phase without legal changes, tax and fiscal legislation should be modified to increase property tax collection, through adjustments to the tax base, rates, and fees, and to align cadastral values with those of the real estate market. Téllez argued that, in Mexico City, the property tax is calculated by applying the rate of Article 130 of the local Fiscal Code to the cadastral value, according to Articles 127 and 130. Therefore, she claimed that adjusting the base and rates with the stated purpose of collecting more would raise the payment, even if a rate increase was not announced. She also pointed out that, if the Program were approved, Article 38 of the General Law on Human Settlements, Land Use Planning, and Urban Development would allow one year to adjust urban development programs to it. She added that Sedatu had already admitted that the wording was imprecise and requested monitoring of the document before its proposals turned into law. Téllez concluded that, if there would be no increase, those paragraphs should be eliminated before presenting the initiative. #CDMX #OrdenaciónUrbana #Fiscalidad (translated)
