Con este aviso, el “equipo de investigación” @JuanLuisMdP, @Ramon_AlvarezMM, @M_Hache, @MiguelSerranoTV, @elmozo7, @Cuatroamiguetes, @PepeKollins, @Hechi9248, @German_U5, @SemprePerico, @Neiraelvikingo @HdeHelena_RM, @Fanaticos_RMCF y @SerYebra habrían reconocido de facto la existencia de un presunto delito de revelación de secretos al admitir que han tenido que eliminar documentos del sumario para sustituirlos por “réplicas generadas por inteligencia artificial”. En términos jurídico‑penales, esa advertencia equivale a reconocer que previamente habían difundido material protegido por el secreto de actuaciones: firmas, conversaciones privadas (whatsapps), nombres y apellidos, cuentas bancarias, informes médicos y demás datos personales de terceros, todo ello vinculado a un procedimiento penal en curso. La recreación posterior mediante IA no borra la eventual tipicidad de la conducta inicial, porque el núcleo del tipo penal del artículo 197 y concordantes se sitúa en la obtención y divulgación ilegítima de datos reservados, no en el formato concreto del soporte.
