We have a government today that deceives and blackmails Poles, and its entire narrative around this law has been a lie from the beginning. Donald Tusk's cabinet has all the tools to lower fuel prices – it could have done this yesterday, a week, or a month ago. The government will not lower prices based on the law signed by the President from day to day. It comes into effect on November 1st, and the first payments from the new levy will only enter the budget by November 25th. For fuel to become cheaper immediately, the government simply needs to lower taxes. The President made a very responsible decision by signing this regulation and sending it to the Tribunal for subsequent control. Otherwise, citizens would continue to bear the costs of the government's previous deceptions. When the Minister of Finance wants to introduce tax privileges for same-sex couples, a simple tax interpretation suffices – suddenly the law becomes unnecessary, even though it contradicts Article 18 of the Constitution. Since it was possible to act with one administrative decision in that matter, why weren't taxes lowered to relieve Poles paying for the high prices at gas stations, which directly drives inflation? The President consistently implements his strategy: he signs what serves the citizens and blocks poor solutions. We will not allow attention to be diverted from the key problems of Poles: fuel prices, energy, and the cost of living. 2/ Do kompletu mamy art. 7 Konstytucji: "Organy władzy publicznej działają na podstawie i w granicach prawa". I art. 126 ust. 3: " Prezydent Rzeczypospolitej wykonuje swoje zadania w zakresie i na zasadach określonych w Konstytucji i ustawach". To bardzo ważne, Panie Przydacz. Art. 126 ust. 2, zgodnie z którym Prezydent czuwa nad przestrzeganiem Konstytucji, nie tworzy samoistnej kompetencji do wykonywania dowolnej czynności, którą Prezydent uzna za służącą ochronie Konstytucji. W przeciwnym razie art. 126 ust. 3 oraz art. 7 byłyby właściwie zbędne. Prezydent nie może wyprowadzić z funkcji "strażnika Konstytucji" nieprzewidzianej ustawą kompetencji do ponownego prowadzenia postępowania kwalifikacyjnego wobec sędziego Tk wybranego przez Sejm. A właśnie to obecnie robi Pałac. Rzecznik Prezydenta oświadczył publicznie, że Maciej Berek nie zostanie zaproszony do złożenia ślubowania, dopóki nie przedstawi dokumentów potwierdzających spełnianie wymogów formalnych. To nie jest samo "czuwanie nad Konstytucją". To jest postawienie osobie już wybranej przez konstytucyjnie właściwy organ dodatkowego warunku, od którego Pałac uzależnia wykonanie ustawowej czynności Prezydenta. Dlatego zamiast pańskiegohasła: "Pałac po prostu przestrzega prawa" proponuję rzecz znacznie prostszą. Proszę wskazać JEDEN przepis Konstytucji albo ustawy, który przyznaje Prezydentowi RP kompetencję do: 1. ponownej weryfikacji kwalifikacji osoby już wybranej przez Sejm na sędziego TK; 2. żądania od niej dodatkowych dokumentów jako warunku dopuszczenia do złożenia ślubowania 3. prowadzenia własnego postępowania sprawdzającego po zakończeniu procedury sejmowej; 4. uzależnienia wykonania obowiązku wynikającego z art. 4 ust. 1 ustawy od wyniku takiej weryfikacji 5. wstrzymania możliwości złożenia ślubowania do czasu, aż Prezydent uzna przedstawione dokumenty za wystarczające. Konkretny artykuł. Ustęp. Punkt. Bo art. 7 Konstytucji nie pyta, czy organowi wydaje się, że działa w słusznej sprawie. Pyta o podstawę prawną jego działania. Więc naprawdę jestem ciekaw: na jaki dokładnie przepis powołuje się Pan Karol Nawrocki? W mojej ocenie Pałac Prezydencki nie stoi tutaj na straży Konstytucji. Pałac ją narusza - świadomie rozszerzając kompetencje Prezydenta poza granice wyznaczone przez Konstytucję i ustawę. To nie jest żadna obrona praworządności.
