W związku z próbą siłowego przejęcia Akademii Wymiaru Sprawiedliwości wbrew konstytucyjnej zasadzie autonomii uczelni - art. 70 ust. 5 Konstytucji RP, spotkałem się z Rektorem uczelni dr. @michalsopinski, który poinformował o bezprawnych działaniach ministra @w_zurek. Koalicja 13 grudnia doskonale wiedziała, że nie może odwołać rektora Sopińskiego. Dlatego w 2025 r. procedowała ustawę zmierzającą do likwidacji całej Akademii Wymiaru Sprawiedliwości i tym samym wygaszania kadencje rektora i Senatu uczelni. Jednak Prezydent RP @AndrzejDuda zawetował tę szkodliwą ustawę. Mimo tego fiaska rząd premiera Tuska nie odstąpił od próby przejęcia i likwidacji uczelni, podejmując dalsze bezprawne działania. Zgodnie z prawem powszechnie obowiązującym, wyłączną właściwość i kompetencję do powołania i odwołania Rektora Akademii ma Senat uczelni. Wynika to wprost z art. 439 ust. 7 ustawy - prawo o szkolnictwie wyższym, który wskazuje, że art. 66a ustawy o Służbie Więziennej stanowi lex specialis i wyłącza właściwość Ministra Sprawiedliwości w zakresie powoływania i odwoływania Rektora AWS. Mimo tych oczywistych norm prawnych, pan Żurkek postanowił odwołać rektora bez podstawy prawnej w procedurze, której zakazuje sama ustawa - prawo o szkolnictwie wyższym. Czyni to ponadto, pomimo postanowienia zabezpieczającego Trybunału Konstytucyjnego z dnia 27 maja 2026 r., które uniemożliwia mu wydanie decyzji administracyjnej o odwołaniu Rektora. Pomimo jednoznacznego orzeczenia TK, minister Żurek wydał bezprawną decyzję administracyjną o odwołaniu rektora Sopińskiego. Działał przy tym w takim pośpiechu, że nie zdołał nawet poprawnie doręczyć panu rektorowi własnej bezprawnej decyzji, choć z tą elementarną czynnością codziennie bez trudu radzą sobie tysiące listonoszy w Polsce. Atak na Akademię Wymiaru Sprawiedliwości, to kolejna próba bezprawnego wpływania przez ten rząd na niezależność instytucji takich jak TK, SN, KRS i Prokuratura Krajowa. Demokraci walczący nie znoszą niezależnych instytucji, ale Polacy to mądry i niezależny Naród i jestem przekonany, że przypomną o tym rządzącym w czasie wyborów w 2027 r. #Uczelnia #Prawo #Demokracja

On ma swoją chronologię, ma swoich autorów, ma konkretne skutki prawne, ma już także swoje orzeczenia ETPC i TSUE. Więc proszę w końcu przestać zakłamywać historię, niszczyć praworządność i sprowadzać konstytucyjne instytucje do roli narzędzi bieżącej walki politycznej. Przy okazji zmieniacie powagę urzędu Prezydenta RP w polityczną pałkę dla własnego elektoratu, a Trybunał Konstytucyjny w element tej samej wojny, niszczycie nie tylko resztki autorytetu TK, ale również wiarygodność polskiego państwa jako państwa prawa.
