Ao contrário; torna ainda mais necessário olhar para quem agora assume o controle da crise. O inquérito foi instaurado por Dias Toffoli em 2019, sem distribuição ordinária, e Moraes foi designado relator. Mas foi Fachin, como relator da ADPF 572, quem defendeu juridicamente sua constitucionalidade. Em 2020, seu entendimento prevaleceu por 10 a 1. Ou seja: quem hoje retira Moraes da condução ajudou a legitimar a engrenagem que permitiu sua expansão durante sete anos. Em plena crise, Lula mobilizou aliados para conter o desgaste e tentar isolar André Mendonça. Flávio Dino, ex-ministro da Justiça de Lula, e ministro do Supremo derrubou o afastamento do diretor-geral da PF, Andrei Rodrigues. Horas depois, Fachin interveio - acreditar que todos esses movimentos aconteceram de forma absolutamente independente, em poucas horas, dentro da mesma crise e produzindo efeitos convergentes, exige mais do que ingenuidade. Juridicamente, Fachin não anulou os atos de Moraes, não declarou ilegal o inquérito e não extinguiu as ações penais dele derivadas. Fez o contrário: preservou o passado e trouxe para a Presidência do STF o controle das investigações ainda abertas. A troca vale daqui para frente. Portanto, cuidado com a narrativa de que “o sistema caiu”. Não caiu, apenas mudou o timão de mãos. Nada garante que Moraes será investigado, responsabilizado ou afastado. E esse é o ponto mais grave; o Supremo chegou à situação em que deveria investigar e eventualmente julgar os próprios ministros. Quem garante que haverá julgamento de verdade? Quem garante independência para julgar os próprios pares?
