Ao justificar o pedido de vista que suspendeu o julgamento, o decano também questionou o fato de a medida ter sido adotada a partir de uma solicitação de partido político. Gilmar afirmou que pediu vista por três razões. A primeira delas foi o curto intervalo entre a inclusão do caso em pauta e o início do julgamento virtual: segundo ele, o processo entrou na pauta menos de uma hora antes da abertura da sessão, o que impediu uma análise integral dos autos e da decisão. O ministro também levantou dúvidas sobre a possibilidade de o afastamento cautelar ter sido determinado a partir de um pedido de partido político. Para Gilmar, a medida ocorreu em “aparente contrariedade” ao Código de Processo Penal e ao Regimento Interno do STF, que, segundo ele, estabelecem exigências decorrentes do sistema acusatório. Outro ponto ressaltado pelo decano é a definição de qual colegiado do Supremo deve analisar o caso. Gilmar afirmou que incidentes relacionados à mesma investigação foram encaminhados por Mendonça a colegiados diferentes e sustentou haver elementos indicando que a discussão deve ocorrer no plenário, e não na Segunda Turma. Na manifestação, Gilmar cita como um desses elementos a própria decisão que afastou os integrantes da cúpula da PF. Segundo o ministro, Mendonça registrou a existência de indícios de que o relatório de inteligência que embasou a medida teria sido produzido pelo diretor-geral da corporação “por provocação de membro da Primeira Turma” do Supremo. Para Gilmar, se essa premissa for considerada, a análise de atos atribuídos a um integrante da Corte cabe ao plenário. Gilmar lembrou ainda que o próprio Mendonça havia afirmado, em decisão de 1º de setembro, que o exame da matéria deveria ocorrer no plenário, em sessão presencial e pública. O decano também citou o procedimento aberto pelo presidente do STF, Edson Fachin, para analisar as questões relacionadas ao caso, no qual foram solicitadas informações a autoridades como Andrei Rodrigues, o procurador-geral da República, Paulo Gonet, e o ministro Alexandre de Moraes. O prazo de cinco dias para essas manifestações ainda está em curso. O terceiro argumento apresentado por Gilmar envolve os possíveis reflexos eleitorais da decisão.
