The author r00t🇪🇺 accused Bogucki of selective representation of the Constitutional Tribunal's ruling from December 3, 2015, in case K 34/15. He pointed out that Article 194, paragraph 1 of the Constitution entrusts the Sejm with the election of judges of the Tribunal, while the obligation to take an oath before the President results from the law. He referred to points 8.5.1, 8.5.3, and 8.6 of the justification. As he wrote, the Tribunal considered the oath to be an element added by the legislator to the constitutional procedure, and its acceptance by the President was regarded as an obligation. He added that the Tribunal questioned the interpretation of provisions that would not foresee the immediate taking of an oath. The author assessed that the President does not approve the choice made by the Sejm and cannot, based on statutory competence, co-decide on the composition of the Tribunal. He accused Bogucki of omitting parts of the ruling and using it to provoke opposition to the government and to present its actions as an attack on the constitutional order. Referring to Karol Nawrocki, the author reminded that Article 126, paragraph 1 of the Constitution defines the President of the Republic of Poland as the highest representative of the state and the guarantor of continuity of power, while paragraph 3 indicates that he performs his tasks on the principles specified in the Constitution and laws. He wrote that using the authority of the Constitution to justify a political position does not correspond to those obligations. #Konstytucja #Prawo #Polityka (translated)

The author of the entry r00t wrote that the document commented on by Wójcik contradicted his assertion that Maciej Berek did not meet the formal requirements. According to the author, the Chancellery of the Sejm indicated that the application with Berek's candidacy was submitted on time by an eligible entity and contained the required elements, after which it was referred to the Justice and Human Rights Committee. The author added that during the committee meeting, Berek's performance of the legal advisor profession was discussed, and the candidate answered questions. The committee positively assessed his candidacy. r00t accused Wójcik of ignoring the course of the procedure and the documents, which — as he wrote — indicated something contrary to his assertion. #Polska #Prawo #KomisjaSprawiedliwości (translated)

BPM Chief Marcin Przydacz said in wPolsce.pl that the situation surrounding the Constitutional Tribunal resulted from legal errors of the parliamentary majority and the ruling camp, and above all from the desire to take control over this body. He added that in his opinion the ruling camp was simultaneously seeking this control and was unable to adhere to the law. #TrybunałKonstytucyjny #prawo #Polska (translated)

Adam Mazguła 4d

Adam Mazguła criticized Rafał Jankowski and the board of the NSZZ Policjantów after Jankowski stated that police officers "do not stand on the side of the government." He claimed that such a position undermines loyalty to constitutional organs of the state and could lead to anarchy. He accused Jankowski of having political ties to PiS and argued that his statement encourages police officers not to fulfill their duties. Mazguła referred to Article 27, point 1 of the Police Act of April 6, 1990, and cited the oath taken by police officers. He argued that police officers should serve Poland and its constitutional bodies, including the democratically elected government and the Minister of the Interior and Administration. He also accused the NSZZ board and Jankowski of focusing on pay and benefits. The author wrote that Jankowski did not respond to what he described as cases of death following police interventions, the use of violence against women and peaceful demonstrators, the detention of a female MP, the shooting of a “Solidarity” journalist, as well as repression and falsification of evidence against democratic opposition activists. These were Mazguła's accusations against Jankowski. Mazguła urged policewomen and policemen to serve Poland, not politics, and to use force against those breaking the law. He added that since Jankowski informed institutions of his position, he also conveyed his opinion to them. #PrawdąWOczy #WPoczuciuOdpowiedzialności #TarczaWolnościSłowa #BronimyKonstytucji #ŻołnierzGorszegoSortu #PrawaCzłowieka #WolnośćSłowa #ŚwieckośćPaństwa #PrawaKobiet #WojskoPolskie #Policja #Praworządność #Bezpieczeństwo (translated)

Scandal! Maciej Berek, who undermined the status of the Constitutional Tribunal, was illegally 'sworn in' as a judge of the TC without the participation of the President of the Republic of Poland. The goal is clear: to create a political backing for undermining the decisions of President Karol Nawrocki and his mandate! This is what the rule of law looks like according to Tusk: when the law hinders the realization of a political plan, one seeks a foreign opinion that can be used as an alibi. The Venice Commission is an advisory body, and its opinion does not change Polish law or deprive the President of the Republic of Poland of constitutional competences. The President of the TC, Bogdan Święczkowski, has no right to allow a judge who has not sworn allegiance to the President of the Republic of Poland to adjudicate! We will not allow the state to be subordinated to Tusk's political interests. We will defend the Constitutional Tribunal, the prerogatives of the President, and the constitutional order of Poland. There is no consent to bypass the law to achieve political goals!" - wrote PiS MP Przemysław Czarnek on his profile on the X platform. #TrybunałKonstytucyjny #MaciejBerek #Prawo (translated)

Zbigniew Bogucki🇵🇱 6d

Zbigniew Bogucki wrote that the highest law in Poland is the Constitution, and the positions of the Venice Commission are not a source of law or a binding interpretation of Polish provisions. He pointed out that according to Article 87, paragraph 1 of the Constitution, sources of commonly applicable law also include statutes, ratified international agreements, and regulations. He added that the assessment of the compliance of law with the Constitution was entrusted to the Constitutional Tribunal under Article 188, and it resolves jurisdictional disputes between central state authorities based on Article 189. Bogucki argued that according to Article 4 of the Constitution, sovereignty belongs to the Nation, which elected the President in general elections. Referring to Article 126, he defined the President as the highest representative of the state, a guarantor of the continuity of power, and an authority overseeing compliance with the Constitution. Regarding the oath-taking of four judges of the Constitutional Tribunal, Bogucki wrote that the President is waiting for the Tribunal to resolve the jurisdictional dispute. According to him, based on Article 86, paragraph 1 of the Act on the Organization and Procedure before the Constitutional Tribunal, the proceedings related to the oath-taking have been suspended until the dispute is resolved. He added that this was confirmed by the President of the Constitutional Tribunal in a letter dated April 29, 2026, and the President cannot continue actions related to the acceptance of the oath during this time. Referring to Maciej Berek, a former minister in Donald Tusk's government, Bogucki pointed to unexplained doubts regarding his fulfillment of the requirements under Article 3 of the Act on the Status of Judges of the Constitutional Tribunal, including the required experience as a legal adviser. He claimed that the President has a duty to clarify serious and objectively justified doubts regarding the statutory qualifications of the person chosen by the Sejm as a judge of the Constitutional Tribunal before accepting their oath. In his opinion, this act cannot only be ceremonial, and the obligation to accept the oath is not absolute. He referenced Article 126, paragraph 2 and Article 7 of the Constitution. Bogucki wrote that the President not only has the right but also the duty to safeguard the Polish constitutional order. He added that he would do so despite what he termed politicized pressures from within the country and abroad. #Konstytucja #Polska #Prawo (translated)

Cezary Krysztopa wrote that the Venice Commission is an advisory body of the Council of Europe and — as he pointed out, if he remembered correctly — Russia is a member. He also mentioned Wojciech Sadurski, using an offensive term towards him. He stated that the Commission can issue opinions, but in light of the provisions of the Polish constitution, which he referred to as the highest legal act in Poland, it should refrain from doing so. #komentarz #Polska #konstytucja (translated)

DWUKADENCYJNOŚĆ WŁODARZY - TAK, PARLAMENTARZYSTÓW - NIE Ograniczenie liczby kadencji to legislacyjna ingerencja w demokrację. Sens wprowadzenia tych ograniczeń wynika z przekonania, że zwykłe mechanizmy wyborcze nie działają dostateczne skutecznie. W odniesieniu do funkcji wójtów, burmistrzów i prezydentów miast mamy do czynienia z bezprecedensową kumulacją władzy. Wymaga to więc legislacyjnej ingerencji, by zwiększyć szanse wpływu wyborców na zarządzanie wspólnymi sprawami.

Mastocytosis: what is it? Mastocytosis is a rare condition in which there are too many mast cells present in the body. Mast cells are a normal part of our immune system, but in mastocytosis, they accumulate. They can cause symptoms by releasing substances such as histamine. There are different forms of mastocytosis. The main distinction is between cutaneous and systemic mastocytosis. Cutaneous mastocytosis In cutaneous mastocytosis, the mast cells are mainly located in the skin. This form is most common in children. The skin often shows spots or bumps that can be itchy or change color. Cutaneous mastocytosis usually remains confined to the skin and sometimes resolves on its own over time. Systemic mastocytosis In systemic mastocytosis, the mast cells are not only in the skin but also in organs such as the bone marrow, intestines, or spleen. This form is primarily found in adults. The symptoms can therefore be broader and less clear, making the diagnosis difficult at times. (translated)

Dennis Riehle reported back after a longer hospital stay, stating that the examinations had shown that his Parkinson's syndrome was not due to a neurodegenerative process. A genetic cause had most likely been identified. The underlying disease impairs and damages the body's energy cells. Although it progresses more slowly than classical forms of Parkinson's, it affects multiple organs and is more difficult to treat, he wrote. Riehle described the most significant finding as a severe neurocognitive disorder, which he characterized as a form of dementia. In his case, it manifests primarily as difficulties in finding words and fluid speech. For about half a year, he has therefore found it harder to write texts. However, he wants to continue and keep posting on X – presumably less frequently and irregularly, but as much as possible in his usual style. #Parkinson #Gesundheit #Demenz (translated)

What is striking is the enormous diversity of side effects that the #mRNAvaccines can cause. That is not surprising when you realize that the substance reaches almost every organ. This means that the total number of side effects is greatly underestimated if you limit it to a few organs, such as the heart, for example. Moreover, the relationship is often only established - if it happens at all - when the side effect occurs shortly after vaccination. Meanwhile, we know that such a side effect can also occur much later. It remains fascinating. #mRNAvaccins #bijwerkingen #gezondheid (translated)
