Takie działania powinny być surowo karane. Problem polega na tym, że uchwalona ustawa idzie znacznie dalej. Pod hasłem walki z pseudomedycyną tworzy system, który może prowadzić do arbitralnego ograniczania wolności słowa, działalności gospodarczej i debaty naukowej. ➡️ Po pierwsze, najważniejsze pojęcia w ustawie są nieprecyzyjne. O odpowiedzialności obywatela mają decydować takie określenia jak „aktualna wiedza medyczna”, „nieprawdziwa informacja”, „wprowadzanie w błąd” czy „praktyka zagrażająca zdrowiu”. Ustawa nie wskazuje jednak jasno, kto, według jakich źródeł i na jaki dzień będzie ustalał, co stanowi obowiązującą wiedzę medyczną. Nauka rozwija się poprzez spór, badania i podważanie dotychczasowych poglądów, a nie poprzez urzędowe ogłaszanie jednej niepodważalnej prawdy - zwłaszcza tej narzucanej przez skorumpowaną Big Pharmę. ➡️ Po drugie, ogromne kompetencje zostają skupione w rękach jednego organu - Rzecznika Praw Pacjenta. To groźne! Ten sam organ będzie prowadził postępowanie, oceniał materiał, interpretował wiedzę medyczną, wydawał decyzję, publikował ostrzeżenia, prowadził rejestr, ingerował w działanie stron internetowych i nakładał kary. Nie przewidziano obowiązkowej opinii niezależnego zespołu ekspertów ani uprzedniej kontroli sądu przed zastosowaniem najbardziej dotkliwych środków. ➡️ Po trzecie, ustawa pozwala na publiczne napiętnowanie człowieka lub firmy jeszcze przed prawomocnym zakończeniem sprawy. To chore! Już sam komunikat urzędowy o podejrzeniu prowadzenia działalności pseudomedycznej może oznaczać utratę klientów, reputacji i źródła utrzymania. Nawet późniejsze zwycięstwo przed sądem może już nie naprawić wyrządzonych szkód. ➡️ Po czwarte, Rzecznik będzie mógł doprowadzić do przekierowania domeny internetowej na stronę zawierającą urzędowe ostrzeżenie. W praktyce jest to administracyjna blokada dostępu do treści, stosowana bez wcześniejszego rozstrzygnięcia niezależnego sądu. Tak nie działa państwo demokratyczne. ➡️ Po piąte, ustawa przewiduje kary sięgające miliona złotych, możliwość ich wielokrotnego nakładania oraz dodatkowe kary za nieprzekazanie dokumentów. Dla małego przedsiębiorcy lub osoby fizycznej może to oznaczać ekonomiczne unicestwienie jeszcze przed zakończeniem kontroli sądowej. ➡️ Po szóste, przepisy mogą wywołać efekt mrożący. Lekarze, naukowcy, dziennikarze, dietetycy, terapeuci, pacjenci i twórcy internetowi mogą rezygnować z wypowiadania się o działaniach niepożądanych, metodach leczenia, suplementacji czy błędach systemu nie dlatego, że kłamią, lecz dlatego, że nie będą w stanie przewidzieć, jak ich słowa oceni urzędnik. Big Pharma zaciera ręce. ➡️ Po siódme, państwo już dziś posiada narzędzia do ścigania realnych oszustw i zagrożeń. Kodeks karny pozwala karać za oszustwo, narażenie człowieka na utratę życia lub zdrowia, spowodowanie uszczerbku, nieumyślne spowodowanie śmierci czy sprowadzenie zagrożenia dla wielu osób. Państwo powinno ścigać oszustów, a nie ustanawiać urzędowy - często pod naciskiem lobbystów - monopol na prawdę naukową. Dlatego zwracam się do Prezydenta RP o skorzystanie z prawa weta i przekazanie ustawy Sejmowi do ponownego rozpatrzenia. Weto wobec „Lex Szarlatan” będzie działaniem w obronie wolności słowa, prawa do sądu, zasady określoności prawa, wolności działalności gospodarczej i konstytucyjnej zasady proporcjonalności. Posłowie Konfederacji od początku stanowczo sprzeciwiali się projektowi ustawy i głosowali „PRZECIW”. Byłem jednym z nich." #LexSzarlatan #WolnośćSłowa #Konfederacja
