A decisão mais recente no processo de recuperação judicial do Vasco chamou atenção por ter sido assinada pelo juiz tabelar Victor Agustin Cunha Jaccoud Diz Torres, e não pela juíza titular Simone Gastesi Chevrand, da 4ª Vara Empresarial. E existe um ponto que precisa ser esclarecido. As normas do TJRJ sobre tabelamento estabelecem sua utilização em casos de impedimento, suspeição e faltas ocasionais dos magistrados. Ou seja: o simples aparecimento de um juiz tabelar não permite afirmar que houve impedimento ou suspeição, porque também existe a hipótese de falta ocasional. Por outro lado, a norma citada não trata “férias” como uma das hipóteses expressamente elencadas para o tabelamento. Por isso, permanece uma pergunta objetiva: Qual foi, oficialmente, o motivo da substituição da juíza Simone Chevrand neste caso? Até que exista informação oficial sobre a razão da atuação do juiz tabelar, qualquer afirmação de impedimento, suspeição ou outro motivo seria especulação. Ale równe traktowanie pracowników jest problemem nas wszystkich. Nie kwestionuję bólu menstruacyjnego. Jeśli pracownica cierpi tak mocno, że nie może wykonywać pracy - potrzebuje pomocy, diagnozy, leczenia i możliwości odpoczynku. Dokładnie tak samo jak mężczyzna cierpiący z powodu migreny, kolki nerkowej, choroby urologicznej czy innej poważnej dolegliwości. Jeżeli obok mnie ktoś cierpi to pomogę mu dotrzeć do lekarza. Nie będę najpierw pytał, jakiej jest płci i który organ boli oraz jak mocno. Pani odpowiedź omija sedno sprawy. Nikt nie pytał, czy mężczyźni miesiączkują. Pytanie brzmi - dlaczego w nadzorowanych przez Panią OHP pracownice otrzymały prawo do nawet 12 dodatkowych, pełnopłatnych dni wolnych rocznie, a pracownik cierpiący z powodu równie silnego bólu nie ma żadnego odpowiednika? Jedna osoba dostaje dodatkowy płatny dzień. Druga musi skorzystać z urlopu wypoczynkowego albo zwolnienia lekarskiego. Jedynym kryterium różnicującym jest płeć. To nie jest równe traktowanie. Solidarność pracownicza nie polega na dzieleniu bólu na kobiecy, zasługujący na dodatkowe uprawnienie, i męski, który pracownik ma rozwiązać sam. Solidarność polega na tym, że każda osoba czasowo niezdolna do pracy otrzymuje pomoc według stanu zdrowia, a nie płci. Jeżeli celem jest umożliwienie jednego dnia odpoczynku bez biurokracji lekarskiej, wprowadźmy dzień zdrowotny dostępny dla każdego pracownika. Jeżeli problemem jest bolesna menstruacja, zapewnijmy szybką diagnostykę i leczenie, także endometriozy. Ale nie twórzmy dodatkowego świadczenia wyłącznie dla jednej płci, a pytań o jego zgodność z zasadą równego traktowania nie zbywajmy wykładem o biologii. Dobre intencje nie uchylają prawa do równego traktowania. Prawa pracownicze są dla wszystkich. Koniec i kropka. #równość #prawapracy #solidarność
