Si el Atlético apartase a Julián del grupo de manera abusiva por ejemplo, obligándole a entrenar solo, excluyéndole sin razón objetiva de la dinámica deportiva o utilizando su inscripción/desinscripción como presión para que acepte una salida o cambie sus condiciones, podría activarse ese artículo. Si Julián resolviera con justa causa acreditada, el Atlético no tendría derecho a indemnización alguna ni al pago de su cláusula de rescisión. La regulación FIFA identifica expresamente como conducta prohibida separar abusivamente al jugador de los entrenamientos del equipo. Pero no bastaría una decisión técnica ordinaria: no ser convocado, rotar o perder la titularidad no equivalen automáticamente a justa causa. Habría que acreditar un apartamiento grave, persistente, sin explicación deportiva legítima y con finalidad coactiva; antes de resolver, debería requerir formalmente al club que cese la situación y preservar todas las pruebas. En resumen, el artículo 14 RETJ permite resolver con justa causa cuando el incumplimiento grave hace inexigible continuar el contrato. El TAS lo ha reconocido en CAS 2015/A/3999 & 4000, pues avaló la salida ante marginación abusiva: exclusión injustificada del entrenamiento colectivo durante 32 días, o aislamiento, expulsión del alojamiento y presión para firmar una rescisión.
