Joseph Haydn is rightfully remembered as a titan of Western classical music. The “Father of the Symphony” and the “Father of the String Quartet” spent his long life building the structural foundations of the Classical era, mentoring a young Wolfgang Amadeus Mozart, and teaching a tempestuous Ludwig van Beethoven. When he passed away in Vienna in 1809 at the age of 77, the musical world wept. Yet, while his musical legacy remained perfectly intact, his physical body was about to endure one of the most grotesque and surreal misadventures in music history. Haydn’s death coincided with the Napoleonic occupation of Vienna. Because of the wartime chaos, the celebrated composer was hastily buried in a simple, unglamorous grave at the Hundsturm cemetery. A proper, grand burial would have to wait. But just days after his funeral, under the cover of darkness, two men bribed the local gravedigger, exhumed the composer’s fresh corpse, and cleanly severed his head. Wniosek o niezwłoczne podjęcie działań konsularnych w sprawie zatrzymanych obywateli Rzeczypospolitej Polskiej Szanowny Panie Chargé d’affaires @PLinDeutschland, zwracam się z pilnym wnioskiem o podjęcie wszelkich działań pozostających w kompetencji kierowanej przez Pana placówki dyplomatyczno-konsularnej w związku z zatrzymaniem obywateli Rzeczypospolitej Polskiej na terytorium Republiki Federalnej Niemiec. Podkreślam, że ochrona obywateli polskich za granicą stanowi podstawowy i bezwzględny obowiązek państwa polskiego realizowany poprzez jego przedstawicielstwa dyplomatyczne i konsularne. W związku z powyższym oczekuję niezwłocznego działania w ramach obowiązujących norm prawa międzynarodowego oraz prawa krajowego. Wnoszę w szczególności o: 1. Natychmiastowe ustalenie miejsca przebywania zatrzymanych obywateli RP, 2. Nawiązanie z nimi bezpośredniego kontaktu konsularnego, 3. Weryfikację legalności zatrzymania oraz warunków detencji, 4. Dopilnowanie pełnej realizacji ich praw procesowych, 5. Zapewnienie realnego dostępu do pomocy prawnej i tłumacza, 6. Poinformowanie rodzin w Polsce o ich sytuacji, 7. Podjęcie wszelkich możliwych działań interwencyjnych wobec właściwych organów niemieckich. Podstawa prawna 1. Vienna Convention on Consular Relations, w szczególności: art. 5 – określający funkcje konsularne, w tym ochronę interesów obywateli państwa wysyłającego, art. 36 – gwarantujący prawo do kontaktu konsularnego w przypadku zatrzymania, obowiązek informowania konsula oraz umożliwienie komunikacji z obywatelami. 2. Vienna Convention on Diplomatic Relations, w zakresie ogólnego obowiązku ochrony interesów państwa wysyłającego oraz jego obywateli przez misje dyplomatyczne. 3. Prawo konsularne (Polska), które nakłada na konsula obowiązek podejmowania działań w celu ochrony praw i interesów obywateli RP za granicą, w szczególności w przypadkach pozbawienia wolności. Podkreślenia wymaga, że ochrona obywateli Rzeczypospolitej Polskiej za granicą stanowi jeden z fundamentalnych obowiązków polskiej służby zagranicznej, realizowany w szczególności poprzez działania konsularne i interwencyjne wobec władz państwa przyjmującego. Mając na uwadze powagę sytuacji, uprzejmie wnoszę o potraktowanie sprawy jako wymagającej niezwłocznej interwencji.
