Der Datenschutzbeauftragte des Freistaates Sachsen bestätigte jetzt den Rechtsverstoß durch einen Zahnarzt, der eine mindestens hohe dreistellige Zahl an Patientendatensätzen genutzt hat, um ungebeten Anti-Hartung-Propaganda und CDU-Wahlaufrufe zu verbreiten. Und damit das Vertrauen seiner Patienten für eine unrechtmäßige Wahlbeeinflussung missbrauchte. Im Gesetz heißt in § 27 des Sächsischen Kommunalwahlgesetzes zur Ungültigkeit einer Wahl eindeutig: „Die Wahl ist für ungültig zu erklären, wenn ihr Ergebnis dadurch beeinflusst werden konnte, dass […] 2. Bewerber oder Dritte bei der Wahl eine gegen ein Gesetz, insbesondere die §§ 107, 107a, 107b, 107c, 108, 108a, 108b, 108d Satz 2 oder § 240 des Strafgesetzbuches verstoßende Wahlbeeinflussung begangen haben.“ Dass ein Verstoß gegen gesetzlich Bestimmungen vorliegt, hat jetzt auch der Sächsische Datenschutzbeauftragte bestätigt, wenngleich die "Strafe" für den Arzt mit einer Verwarnung denkbar gering angesetzt ist. Für das Verwaltungsverfahren und die Frage nach der Ungültigkeit der Wahl ist das aber unerheblich: Wer gesetzeswidrig in vielen hundert Fällen mit illegal genutzten Patientendaten Einfluss auf die Wahl ausübt, verstößt eindeutig gegen das Gesetz. Mittlerweile ist unsere Klage beim Verwaltungsgericht Chemnitz anhängig und wir sind, gerade auch nach den neuesten Entwicklungen, sehr zuversichtlich, dass die Wahl-Schande von Aue-Bad Schlema aufgeklärt wird.
