Sam pan Święczkowski przyznał, że zabrakło kworum, a mimo tego przesłał Ministerstwu Finansów dokument "zatwierdzony przez prezesa TK" 🤷‍♂️ Ministerstwo uznało, że nie otrzymało skutecznie uchwalonego aktu planistycznego i dlatego nie włączyło tej części do projektu budżetu. A teraz właśnie ten brak ma stać się argumentem, że ustawa budżetowa w ogóle nie jest ustawą budżetową, zaś ewentualny spór miałby trafić do... Trybunału, którego własna procedura budżetowa leży u źródła całego problemu🤦‍♂️ To rodzi jeszcze prostsze pytanie. Jeżeli według Pana taki akt NIE JEST ustawą budżetową w rozumieniu art. 225 Konstytucji, to na jakiej podstawie miałby być jednocześnie ustawą budżetową, którą Prezydent może skierować do TK w trybie art. 224 ust. 2?🫣 Nie można zmieniać kwalifikacji tego samego aktu w zależności od tego, który skutek konstytucyjny jest akurat potrzebny. A przypisywanie rządowi skutków sytuacji, która rozpoczęła się od nieuchwalenia planu finansowego przez właściwy organ samego TK, jest już szczególnie osobliwą konstrukcją.
