Vamos aplicar ao caso de Moraes o raciocínio usado por ele para jogar qualquer cidadão no inquérito das fake news por ameaça à democracia e para condenar policiais militares pelo 8/1 por omissão: 1) Daniel Vorcaro atacou instituições brasileiras ao tentar travar investigações de PF e MP, e evitar a própria prisão, explorando a influência do marido magistrado de advogada contratada por ele, além de ter supostamente corrompido dois diretores do Banco Central e um do BRB em troca de favores e informações sigilosas; 2) O marido magistrado da advogada contratada por Vorcaro, no mínimo, falhou em agir diante de propósitos criminosos que eram “plenamente difundidos e conhecido”; 3) Neste sentido, Moraes também teria incorrido em conduta que, em tese, pode ser configurada como “antidemocrática”, omitindo-se diante de tamanho ataque ao Estado Democrático de Direito; 4) Logo, há razões para investigar Moraes no âmbito do inquérito das fake news, relatado pelo próprio Moraes; 5) Sei que eu não deveria dar ideia, porque Moraes não se incomoda em assumir vários papéis no mesmo processo e, assumindo também o de alvo dessa vez, poderia tomar de André Mendonça a relatoria e, como relator, aliviar a si próprio como investigado; 6) Ou Mendonça, seguindo o Direito criativo de Dias Toffoli, poderia abrir de ofício um novo inquérito das fake news, designando um colega como Kassio Nunes Marques ou Luiz Fux como relator; 7) Neste caso, o processo correria sem necessidade de aval da PGR ora chefiada por outro integrante do clube do whisky, Paulo Gonet, amigo íntimo de Moraes e Vorcaro, de quem sentia saudades. 8) Descrevo esses cenários não por defender originalmente esses caminhos, claro, mas para mostrar como os puxadinhos de ministros do STF poderiam ser usados contra eles próprios, se mantivessem a coerência que lhes falta nas alegações, mas sobra na blindagem, com toda a sua inerente hipocrisia.
