Čtu reakce na návrh vlády na vyloučení soudce Pavla Šámala. Prý útok na Ústavní soud. Nezlobte se, ale takhle právo opravdu nefunguje. V každém soudním řízení má účastník právo namítnout podjatost soudce, pokud je přesvědčen, že pro to existují důvody. Je to běžný procesní institut, nikoli útok na justici. To podstatné je něco jiného. O vyloučení soudce nerozhoduje ten, kdo námitku podal. Rozhoduje o ní soud. Klidně kritizujte, že je takový návrh nedůvodný. Na to má každý právo. Ale tvrdit, že samotné využití zákonného procesního prostředku je útokem na Ústavní soud, je právní a logický nesmysl. Právní stát přece stojí na tom, že všichni mohou využívat procesní práva, která jim zákon dává.
