A CPI do Banco Master está presa num labirinto institucional. O requerimento apresentado pelo senador Alessandro Vieira em 9 de março foi protocolado com 35 assinaturas e depois chegou a 41 - acima das 27 exigidas pela Constituição. Passaram-se quase seis meses sem que o presidente do Senado, Davi Alcolumbre, desse andamento ao pedido. Nesta terça-feira, 22 de setembro, surgiu outro obstáculo. Cristiano Zanin negou a liminar que buscava obrigar o Senado a instalar a comissão, fundamentando que ainda não estaria comprovada, de forma “pré-constituída e inequívoca”, a omissão de Alcolumbre. Segundo Zanin, é preciso esclarecer como foram tratados outros requerimentos sobre o Banco Master e se existe sobreposição entre eles. O artigo 58 da Constituição estabelece três requisitos para a criação de uma CPI: apoio de um terço dos senadores, fato determinado e prazo certo. E a própria jurisprudência do STF afirma que, cumpridas essas condições, a criação da comissão constitui direito da minoria parlamentar e não depende da conveniência política da maioria ou da Presidência da Casa. Em 2021, o próprio Supremo confirmou uma liminar obrigando o Senado a instalar a CPI da Pandemia. Na ocasião, a Corte afirmou expressamente que, preenchidos os requisitos constitucionais, não cabe omissão nem análise de conveniência política pela Presidência do Senado. E no caso Master não existe apenas esse requerimento. Outro pedido relacionado ao escândalo chegou a reunir 53 assinaturas e também foi levado ao Supremo diante da falta de andamento no Senado. O quadro objetivo pintado por Zanin é constrangedor; pedidos com assinaturas de sobra permanecem meses sem avançar e, quando parlamentares recorrem ao STF, ouvem que ainda faltam elementos para comprovar a omissão. Sejamos claros: no caso Master, não faltam assinaturas, fatos ou gravidade; falta a CPI sair do papel. Alcolumbre não instala, Zanin não determina a instalação e o resultado é uma investigação travada, apesar do respaldo constitucional. Warde agora diz que tratava com Marcola e outros integrantes do governo, não diretamente com Lula. Ou seja, a interlocução com o Planalto existia. E vejam quem é o mensageiro. O escritório de Warde teve como sócia Roberta Rangel, então mulher de Toffoli. Toffoli depois assumiu a relatoria do caso Master e só largou o osso quando os vínculos de seu entorno familiar com personagens e fundos ligados ao caso vieram à tona. O escritório da mulher de Moraes tinha contrato de R$ 131 milhões com o Master, R$ 3,6 milhões por mês, para atuar em inquéritos da PF, no Banco Central, na Receita, no Cade e no Congresso. O escritório da família Lewandowski recebia R$ 250 mil mensais do banco, contrato que seguiu enquanto ele era ministro da Justiça. Em dezembro de 2024, Vorcaro orientou seu diretor jurídico a chamar o filho do ministro: "Temos um contrato. Tem que chamar ele urgente. [...] E dá algum caso ou parecer para ele fazer". Eis a juristocracia exposta: advogados poderosos, ex-ministros e parentes de ministros circulando entre Planalto, Esplanada e Supremo, com a mesma chave para todas as portas. Isso não é o lobby que sempre existiu, por mais nefasto que ele seja. O lobby tradicional buscava interesses: um contrato, uma regra favorável. Pressionava o poder, mas ficava do lado de fora. A rede exposta pelo Master evoluiu para exercer o controle político efetivo do país: define quem é investigado e quem é poupado, quem é censurado, quem vai preso e quem pode disputar eleição. Virou um governo paralelo, que engoliu as instituições e detém o poder de fato, sem jamais ter recebido um voto. E tomou o caminho autoritário em 2019, quando o Supremo abriu por portaria, sem o Ministério Público, o inquérito das fake news. Um de seus primeiros atos foi censurar uma reportagem que ligava Toffoli a Marcelo Odebrecht. Para blindar a rede, era preciso calar quem a expunha. Depois, a repressão só se expandiu. Em nome do combate aos "atos antidemocráticos", milhares passaram pela máquina de inquéritos e processos, perfis foram censurados e centenas terminaram atrás das grades. O excepcional virou permanente: questionar o sistema passou a significar ser tratado como inimigo dele. O mais grave: nenhum mecanismo de controle deteve a rede a tempo. Ela só emergiu quando o Master colapsou. E, mesmo exposta, não se corrige. Em dezembro de 2025, Gonet arquivou o pedido de investigação sobre o contrato da mulher de Moraes.
