A quem Cármen Lúcia pediu desculpas? Ontem, no STF, a ministra Cármen Lúcia pediu desculpas ao povo brasileiro. Foi um momento solene, quase comovente. Mas fiquei com uma dúvida inconveniente: desculpas exatamente pelo quê? Seriam para Débora do Batom, que recebeu 14 anos de prisão em julgamento no qual a própria ministra votou pela condenação? Ou para os brasileiros que consideram desproporcionais muitas das prisões e penas decorrentes do 8 de janeiro? Talvez, depois de tantos anos, tenha surgido no Supremo uma descoberta extraordinária: a de que a Constituição também deve proteger aqueles de quem não gostamos. Ou seriam desculpas aos “200 milhões de tiranos”? Talvez a ministra tenha percebido que o brasileiro comum, esse personagem incômodo que trabalha, paga impostos e ocasionalmente insiste em ter opinião própria, não seja afinal um tirano tão perigoso. Ou, quem sabe, as desculpas fossem destinadas a uma plateia mais refinada: juristas, jornalistas e intelectuais que toleraram medidas excepcionais porque acreditavam que elas seriam usadas apenas contra Jair Bolsonaro. A estes, o pedido poderia ser mais específico: “Perdão. Prometemos que a excepcionalidade terminaria quando o inimigo fosse derrotado. Esquecemos apenas de mencionar que poderes extraordinários raramente percebem quando chegou a hora de ir embora.” Desde 2019, Cármen Lúcia esteve lá. Assistiu ao nascimento do inquérito das fake news, aberto de ofício e alvo desde então de intensa controvérsia jurídica. Viu suas fronteiras se expandirem. Participou dos julgamentos do 8 de janeiro. Durante todo esse tempo, críticos denunciaram violações ao devido processo legal, desproporcionalidade de penas e concentração excessiva de poderes. O Supremo rejeitou essas críticas. Agora, quando as divergências e acusações alcançam o interior da própria Corte, surge o constrangimento. É uma peculiaridade humana bastante antiga: o abuso costuma parecer muito mais nítido quando deixa de visitar a casa do adversário e toca a campainha da nossa. Talvez, porém, estejamos procurando profundidade demais onde havia apenas cerimônia. Talvez Cármen Lúcia tenha pedido desculpas simplesmente porque, diante do espetáculo de ontem, alguém precisava parecer constrangido. Uma espécie de “foi mal, pessoal” institucional: suficientemente grave para os jornais da noite, suficientemente vago para não reconhecer erro algum. Afinal, pedir desculpas sem dizer pelo quê é uma invenção admirável: preserva-se a aparência do arrependimento sem o inconveniente de assumir responsabilidade. Não sei a quem Cármen Lúcia pediu desculpas. Mas seria útil que explicasse. Se acredita que o Supremo cometeu excessos, diga quais. Se entende que direitos fundamentais foram violados, diga quando. Se considera que penas foram desproporcionais, ajude a corrigi-las. E, se acredita que nada disso aconteceu, então explique por que pediu desculpas. Porque o Brasil não precisa de uma fotografia de uma ministra constrangida para o Jornal Nacional. Precisa saber do que, exatamente, ela se arrepende. #CármenLúcia #STF #Justiça
