Szkoda tylko, że doczytał Pan art. 133 do ust. 1 pkt 2. Bo już ust. 3 stanowi, że w zakresie polityki zagranicznej Prezydent współdziała z Prezesem Rady Ministrów i właściwym ministrem. A art. 39 ustawy o służbie zagranicznej mówi jeszcze wyraźniej: ambasadora Prezydent mianuje i odwołuje NA WNIOSEK ministra spraw zagranicznych, zaakceptowany przez Prezesa Rady Ministrów. Panie Święczkowski @TK_GOV_PL tu pojawia się problem znacznie poważniejszy niż sama Pańska ocena działań Ministra Sprawiedliwości. Występując publicznie jako Prezes Trybunału Konstytucyjnego, stwierdza Pan już teraz, że działania jednej strony konfliktu były bezprawne i stanowiły przestępstwo. To nie jest neutralna informacja o stanowisku TK. To jest publiczne przesądzenie oceny prawnej konkretnego sporu. Tymczasem art. 39 ust. 2 pkt 2 ustawy o organizacji i trybie postępowania przed TK przewiduje wyłączenie sędziego, gdy istnieją okoliczności mogące wywołać wątpliwości co do jego bezstronności 🤷♂️ Jak więc sędzia, który poza salą rozpraw publicznie ogłasza już bezprawność, a nawet przestępczy charakter działania jednej strony, miałby następnie zachować pozór bezstronności w sprawie dotyczącej tego samego konfliktu? I jeszcze jedno, stwierdzenie, że ktoś dopuścił się przestępstwa, nie jest figurą retoryczną. Proszę więc wskazać konkretny typ czynu zabronionego, znamiona, które według pana zostały zrealizowane, i podstawę, na której jako Prezes TK publicznie przesądza Pan odpowiedzialność karną. Bo w mojej ocenie, sędzia konstytucyjny nie powinien najpierw wydawać publicznego werdyktu, a dopiero później zastanawiać się nad swoją bezstronnością. #TrybunałKonstytucyjny #Sprawiedliwość #Bezstronność
