A few days ago, I noticed how Javier Cremades, the chairman of the World Jurist Association, was presented in Poland during the celebrations of the 40th anniversary of the Constitutional Tribunal. The President's Chancellery officially stated that: - Javier Cremades was the honorary guest of the 40th anniversary of the CT, - his visit to Warsaw was related to this anniversary, - the event took place under the honorary patronage of the President of the Republic of Poland, - during the meeting with Marcin Przydacz at the Presidential Palace, they discussed the constitutional role of the Constitutional Tribunal. The CT itself presented the anniversary as an international conference regarding the role of the Tribunal in safeguarding the rule of law and constitutional freedoms and rights. In such an environment, the presence of the chairman of one of the most recognizable international legal organizations could be interpreted as a form of international recognition of the current Tribunal or at least its current functioning. I did not want to assume that. Therefore, as a representative of ECLIR, I directly reached out to the World Jurist Association with a question about whether Javier Cremades's presence in Warsaw should indeed be understood in this way. Today I received a response. And here the matter becomes very interesting. The World Jurist Association explains directly that: - it did not participate in any actions supporting either the current or previous leadership of the Constitutional Tribunal; - Javier Cremades's statements referred to general principles of judicial independence and constitutional judiciary; - they did not aim to support any specific institutional, judicial, or political position; - neither the WJA nor Javier Cremades issued any opinion regarding the current functioning of the Polish Constitutional Tribunal; - they did not conduct any research or legal analysis in this regard; - they did not assess whether the current functioning of the CT meets the standards of judicial independence, institutional legitimacy, or the rule of law. So it must be said very precisely: Javier Cremades's presence during the 40th anniversary of the CT did not constitute confirmation by the World Jurist Association that the current Constitutional Tribunal operates correctly, in accordance with the standards of independence or the rule of law. Such an assessment was simply not made by the WJA. I do not claim that the official statement from the President's Chancellery directly assigned such a position to the WJA, but the way the visit was presented, the rank of the guest, the context of the anniversary, and the emphasis on his presence could create such an impression. That is why it was worthwhile to ask directly from the source. And this is precisely what a reliable institutional analysis exists for: not to infer others' intentions, but to check what a given institution actually said and what it did not say. Of course, the state has the right to explain various things. However, the case of Ms. Director Plakwicz has its roots nine years back. The proceedings in this matter have been ongoing for several years. The director testified and participated in various procedural activities that were conducted during this proceeding. She did not hinder them in any way. On the contrary, she was always available. So the fundamental question is: what is the reason for the arrest if we are dealing with a person who is an official, it is known where she is, she has not hidden anywhere, has not hindered anything, and has participated in the activities? And suddenly, in my opinion, solely for the purpose of such a political show, a woman, I emphasize: a woman, must be arrested and transported to another city, to Rzeszów. I was a prosecutor, nearly 10 years a lawyer. In such cases, if someone were to do something, to obstruct or influence the proceedings unlawfully, they could have done so long ago. I do not find justification, in short, I do not find justification for this kind of action. I do not resolve this matter. However, I see a political context here, that is, hitting Ms. Director Plakwicz, hitting a woman. Of course, it is also about hitting the President, it is about hitting the Chancellery, it is about hitting Karol Nawrocki himself. However, detaining someone almost a decade after the event, when we have documents, when we have participation in these proceedings, because I emphasize again: the director, and perhaps similarly in the case of Mr. Editor, participated in various activities of these proceedings for several months now, raises fundamental questions. It is not the case that suddenly nets need to be thrown, handcuffs put on, and thrown into a police car. I think that is precisely the point: perhaps we will scare someone, perhaps we will extort something from someone, perhaps we will extract some testimonies, perhaps they will implicate someone else. This is absolutely unacceptable in a democratic state that is governed by principles. I say this again, there are no grounds for applying this kind of, in my opinion, repression. (translated)
