Pentru acel jalon, Guvernul era deja în discuții avansate cu Comisia Europeană pentru a explica, în baza unui studiu pregătit de Transelectrica și prezentat ACER, că există riscuri majore dacă închidem capacități adiționale de producție a energiei. Aceasta era o poziție asumată de Guvern și negociată direct cu Bruxelles-ul pentru a diminua efectele unor eventuale penalități.
