Roman Giertych jako adwokat broniący Krala działa w oczywistym konflikcie interesów, bo jest posłem obecnej większości parlamentarnej. To, co dla Krala dobre z perspektywy jego interesu (np. milczenie), nie musi być dobre z perspektywy Giertycha jako posła (dla niego dobre jest, żeby Krall sypał). Poza tym Giertych jednocześnie występuje jak przeciwnik Prokuratory (Giertych-adwokat) i jako jej potencjalny recenzent i kontroler (Giertych-poseł). Jak w przypadku M. Berka pojawia się więc pytanie - czy nie było kogoś innego, kto nie budziłby takich kontrowersji, i czy osądzenie afery krypto nie byłoby możliwe bez udziału Giertycha-posła? Podobnie jak w przypadku M.
