Patryk Wild wrote that the new regulations regarding railway tunnels may force the redesign of the tunnel and the CPK terminal. According to him, Article 41, paragraph 2 of the regulation requires that the supports of tunnels located under buildings be at least 4 meters away from the axis of the main tracks. Wild assessed that the current design requires changes in 99 percent of cases, as part of the tunnel runs under the terminal. He pointed out that the regulations would mean the necessity of running tracks in a nave wider than 12 meters between supports, or each track in a separate nave wider than 8 meters. Wild claimed that the tunnel project, which was nearing completion, and the terminal, for which a building permit was being obtained, were prepared in accordance with previous Polish regulations, EU TSI Infrastructure requirements, and the knowledge of design firms. According to him, the disputed provision was not included in the original draft of the regulation nor was raised during consultations, but appeared after their conclusion, in February of this year. Wild argued that the regulation concerned one facility in Poland, for whose design over 2 billion PLN had been issued or needed to be issued, taking into account the work already completed. The author linked the emergence of the provision to the Ministry of Infrastructure and wrote that oversight of the construction of CPK was exercised by the plenipotentiary, Deputy Minister Piotr Malepszak, who also supervised the ministry department that prepared the regulation. He added that the NeoCPK management could have requested an exemption from the minister, but he considered such a scenario unlikely. He suggested that the person responsible for the decisions should explain their effects to prosecutors. Wild assessed that with such requirements, neither the Central Station in Warsaw nor the Hauptbahnhof in Berlin would have been built. He also predicted that the regulations would prevent the construction of the northern frontage of Aleje Jerozolimskie above the tracks, as the new tunnel would have to be wider. In a broader context, he mentioned the dismissal of Maciej Lasek, a lack of funds for the investment, and the exclusion of CPK from the law on accelerating strategic investments, while including Duoport.
