Mr. President, is this some kind of joke? We are talking about the Constitutional Tribunal. About judges who are supposed to assess the compatibility of law with the Constitution 🤷‍♂️ It would be appropriate to at least know the law regulating the disciplinary responsibility of one's own judges 🤦‍♂️ Article 27 of the law on the status of judges of the Constitutional Tribunal is really quite simple. The President of the Tribunal does NOT initiate disciplinary proceedings. The President, upon receiving a notification, appoints a disciplinary spokesperson by drawing lots. Then the spokesperson - conducts preliminary clarifying activities, - listens to the judge, - assesses whether there are grounds for initiating proceedings at all. And only then, IF such grounds are established, the SPOKESPERSON initiates disciplinary proceedings and presents charges. They can also do something completely opposite - refuse to initiate it 🤷‍♂️ Meanwhile, the official communiqué of the Constitutional Tribunal states that the President "initiated the proceedings" which may result in disciplinary charges. No 🤦‍♂️ Either we are talking about activities preceding the possible initiation of disciplinary proceedings - and then it should be written that way. Or we are talking about formal disciplinary proceedings - and then the law clearly indicates who initiates them. But that’s not the end... The Tribunal also writes about judges filing a notification of "an uncommitted crime." How does the Tribunal already know today that no crime was committed? 🤔 The prosecutor's office initiated proceedings precisely based on the notification from Magdalena Bentkowska and Dariusz Szostek, and on September 23 presented charges against two individuals performing duties in the Tribunal. This of course does NOT mean that a crime was committed. The presentation of charges does not determine that, but for the same reason the Tribunal cannot reverse this reasoning and present as an established fact that it concerned an uncommitted crime 🤦‍♂️ And at the very end of the communiqué, we also get information about the possibility of judges being removed from office. Yes. Such a penalty exists. Only that there must be a spokesperson, clarifying actions, possible initiation of proceedings, presentation of charges, a request to the disciplinary court, and proceedings before that court. In the first instance, three judges of the Tribunal make a ruling. In the second - five. Only a final ruling on the removal of a judge from office can lead to the expiration of the mandate. Do we really have to explain this to the Constitutional Tribunal? I am not prejudging whether these judges committed a disciplinary offense, but if the body whose task it is to uphold the Constitution publicly initiates a procedure against its own judges, it should at least accurately describe the procedure that it itself applies 🤷‍♂️ In law, words matter. In the communiqué of the Constitutional Tribunal - they should have particular significance, which is why this sounds to me like some kind of disgusting joke 🤦‍♂️ (translated)

Na odpowiedzialność karną Ministra Waldemara Żurka wprost wskazują niekwestionowane autorytety prawnicze, jak chociażby profesor Jacek Zaleśny z Uniwersytetu Warszawskiego. Panie Święczkowski @TK_GOV_PL tu pojawia się problem znacznie poważniejszy niż sama Pańska ocena działań Ministra Sprawiedliwości. Występując publicznie jako Prezes Trybunału Konstytucyjnego, stwierdza Pan już teraz, że działania jednej strony konfliktu były bezprawne i stanowiły przestępstwo. To nie jest neutralna informacja o stanowisku TK. To jest publiczne przesądzenie oceny prawnej konkretnego sporu. Tymczasem art. 39 ust. 2 pkt 2 ustawy o organizacji i trybie postępowania przed TK przewiduje wyłączenie sędziego, gdy istnieją okoliczności mogące wywołać wątpliwości co do jego bezstronności 🤷‍♂️ Jak więc sędzia, który poza salą rozpraw publicznie ogłasza już bezprawność, a nawet przestępczy charakter działania jednej strony, miałby następnie zachować pozór bezstronności w sprawie dotyczącej tego samego konfliktu? I jeszcze jedno, stwierdzenie, że ktoś dopuścił się przestępstwa, nie jest figurą retoryczną. Proszę więc wskazać konkretny typ czynu zabronionego, znamiona, które według pana zostały zrealizowane, i podstawę, na której jako Prezes TK publicznie przesądza Pan odpowiedzialność karną. Bo w mojej ocenie, sędzia konstytucyjny nie powinien najpierw wydawać publicznego werdyktu, a dopiero później zastanawiać się nad swoją bezstronnością. #TrybunałKonstytucyjny #Sprawiedliwość #Bezstronność
