Enthüllungsjournalist Janich gewinnt Verfassungsbeschwerde Unser Mandant @OliverJanich saß 5 Monate in rechtswidriger Abschiebehaft auf den Philippinen. Nun hat ihm das Bundesverfassungsgericht recht gegeben. Sein Fall wird neu aufgerollt. Eine herbe Klatsche für die Münchener Justiz. Es kommt selten vor, dass eine Verfassungsbeschwerde Erfolg hat. Im Jahr 2023 beispielsweise gab es das genau 55 Mal beim Bundesverfassungsgericht. Nur etwas über ein Prozent der Beschwerden sind erfolgreich. Umso bemerkenswerter ist es, dass der oppositionelle Publizist Oliver Janich mit einem oppositionellen Anwalt, dem Verfasser, in Karlsruhe Erfolg hatte. Sogar der Generalbundesanwalt teilte in einem Schriftsatz mit, dass der größtenteils zulässig erhobenen Verfassungsbeschwerde der Erfolg nicht zu versagen sein dürfte. Eine herbe Klatsche für die bayerische Justiz, deren häufig autoritäres Rechtsverständnis wieder einmal offenkundig wurde, was den Gang nach Karlsruhe nötig machte. Das Landgericht München muss nunmehr erneut über die sofortige Beschwerde von Janich entscheiden, dem eine Wiedereinsetzung in den vorigen Stand bezüglich des Einspruchs gegen seinen Strafbefehl verwehrt wurde, obwohl er sich in einer offenkundigen Nötigungssituation in einem philippinischen Gefängnis befand. Janich wurde im Gefängnis vielfach mitgeteilt, dass er erst wieder aus der Haft entlassen werden würde, wenn sein Fall in Deutschland abgeschlossen („closed“) sei. Nur deshalb wurde der Strafbefehl von seinem ehemaligen Verteidiger „akzeptiert“. Direkt nach der Entlassung haben wir für unseren Mandanten Einspruch eingelegt und Wiedereinsetzung in den vorigen Stand beantragt. Nach der nunmehr anstehenden erneuten Entscheidung des Landgerichts München wird der Fall zurück zum Amtsgericht gehen, um dort verhandelt zu werden. The important principle is that the social network itself creates the stopping points. During closed periods, messages and notifications could simply be queued. Nothing disappears. But there is no infinite scrolling at 2 a.m., no checking the phone every five minutes, and no expectation that the online social world must be available every waking moment. It also creates a completely different incentive for the platforms. Instead of: “How do we keep this child engaged for another hour?” the objective becomes: “How do we make the hour they have available genuinely worthwhile?” And perhaps weekends should deliberately be different. Children and teenagers should have more freedom when they are not in school — but even then, social media doesn’t need to become a 16-hour continuous session. This would not ban social media. It would regulate continuous access.
