Fachin determinou a remessa à Presidência dos casos Master e INSS com todos os processos a eles relacionados. Não é (ainda) a substituição da relatoria por ele como pessoa-ministro, mas agora a PRESIDÊNCIA DO STF terá acesso a tudo. Conhecendo o histórico de corporativismo do Supremo, é aí que se forma uma colônia de pulgas atrás da orelha. Por que? Porque, em relação aos casos Master e INSS, o ofício não diz “para Fachin”, diz “… à Presidência”. E foi nessa mesma decisão que Fachin determinou que todo e qualquer procedimento envolvendo potencial investigação de integrantes do STF seja encaminhado à Presidência. Ou seja, a Presidência passa a concentrar poderes, inclusive o de direcionar quem será investigado ou não. O argumento de que um presidente do STF é como qualquer outro ministro passa a não existir mais se essa regra permanecer. Por ora, não sabemos os caminhos que essa remessa seguirá e a quais interesses atenderá. O que sabemos é que a Presidência do STF é uma função institucional que muda de ocupante.
