Pisałem milion razy, że prezydent nie może wybrać sobie, od których sędziów TK odbiera ślubowanie. Może sobie co najwyżej wybrać krawat, jaki założy na ślubowanie. Konstytucja RP nie przewiduje żadnej roli dla prezydenta w wyborze sędziów TK. Próba wykorzystania „ślubowania” z ustawy, żeby zablokować funkcję wynikającą z Konstytucji, jest zamachem stanu. Ale wyborcy w takie niuanse nie wnikają - a teraz walka o praworządność toczy się na niwie politycznej, nie prawnej. Oznacza to, że wybór Berka da prezydentowi szansę politycznego wyjścia z twarzą z nielegalnej odmowy przyjęcia ślubowania, którego zostałby pozbawiony, gdyby wybrać do TK kandydata niekontrowersyjnego, podobnego do sędziego Patyry, którego Nawrocki nie odważył się zablokować.
