Ciekawe, skąd bierze się radykalna różnica w polskim i choćby francuskim (z mojego punktu widzenia najświeższy przykład, ale bardzo wyraźnie było to widać także w Szwajcarii, a również w Niemczech czy Austrii) wyznaczaniu obszarów zabudowanych. Sprawdziłem i wyjaśniam: Francuski kodeks drogowy daje jasną i jednoznaczną definicję obszaru zabudowanego: "agglomération: espace sur lequel sont groupés des immeubles bâtis rapprochés et dont l'entrée et la sortie sont signalées par des panneaux placés à cet effet le long de la route qui le traverse ou qui le borde". Wynika z niej, że aby obszar mógł być uznany za zabudowany, muszą być na nim postawione budynki W ZAGĘSZCZENIU (rapprochés). Tymczasem polskie przepisy na poziomie PoRD mówią, że obszarem zabudowanym jest to, co jest oznaczone znakami "obszar zabudowany" ("obszar zabudowany – obszar oznaczony odpowiednimi znakami drogowymi"). To oczywisty nonsens - polska definicja obszaru zabudowanego jest tautologiczna i powinna zostać zmieniona tak, żeby skończyła się absurdalna samowolka w wyznaczaniu jego granic. Są oczywiście normy, mówiące o tym, gdzie w teorii nie powinien się obszar zabudowany rozciągać, ale te normy są traktowane bardzo luźno, zaś kluczowy przepis na to pozwala. #prawo #zagospodarowanie #infrastruktura
