Today's judgments of the CJEU and the opinion of the Advocate General confirm: the circumstances of appointing a Supreme Court judge (at the request of the neoKRS) determine the failure to meet the requirement of an independent and impartial court. In other words: neo-judges in the Supreme Court cannot issue valid rulings. (translated)

The neojudge Kapiński, as the actual but unlawfully directing the Criminal Chamber of the Supreme Court, did not allow motions to exclude neojudges from the Supreme Court. He ordered them to be left unexamined, taking away people's right to an independent and impartial court. The National Prosecutor's Office has initiated an investigation into this matter.
