No. Article 18 is not a legal definition of marriage. Please read the entire sentence. The provision lists the goods and institutions that are under special state protection: marriage, family, motherhood, and parenthood. The phrase "marriage as a union of a woman and a man" defines the constitutional model of marriage but does not turn the entire Article 18 into a legal definition. A legal definition answers the question "what is it?". Article 18 primarily answers the question "what is under the protection and care of the Republic of Poland?". It's really not the same. So if you want to derive further-reaching legal consequences from this provision, please demonstrate it with legal arguments. Simply ripping four words from a sentence is not yet an interpretation of the Constitution 🤷♂️. (translated)
The Bureau of the Ombudsman for Children's Rights exclusively conveyed (at the time information was provided) that the children are outside their home environment. We are in possession of the appropriate documents. "In every case conducted by the Bureau of the Ombudsman for Children's Rights, the Bureau obtains knowledge about the whereabouts of the children from documents provided by other relevant services, institutions, or authorities," writes Monika Horna-Cieślak on X. The priority of Poland remains a rule-based order, rooted in our Constitution and arising from our historical experience. Therefore, we look at the UN not as a place for discussions, but as an institution that must be capable of action. The world has changed – the UN must also change. We need an organization that can respond to violations of the law, enforce rules, and prevent impunity. UN reform cannot be reduced to declarations; it must mean real effectiveness and accountability – also in the face of new challenges, such as the demographic crisis or the development of artificial intelligence, which outpaces existing rules and tests the limits of our responsibility. We stand at a turning point. On one hand, the logic of force and impunity is returning; on the other – technologies that can either entrench this logic or stop it. It is up to our decisions whether the law will be stronger than force, and whether the human will remain more important than the tools he has created himself. Poland will always stand on the side of the law, responsibility, humanity, and freedom. — President of Poland @NawrockiKn, speech during the general debate of the 81st Session of the UN General Assembly. Monika Horna-Cieślak responds to allegations🔥 ➡️ "Everyone acted in accordance with the law and based on the applicable law. No one from the Office of the Children's Rights Ombudsman ever exerted influence in the court regarding what decision it should make..." According to the spokesperson, the phone contact with the duty judge was supposed to concern the information that the Office of the Ombudsman for Children had submitted the appropriate letters and requests in this matter and that the judge should familiarize themselves with them "today." This is all because the entire incident took place on Friday, and institutions do not work on the weekend, so the court would address the matter after the weekend. (translated)
Monika Horna - Cieślak wanted to take children away from their parents because two closed bottles of beer were seen in their house. Now imagine what she would have ordered people with a wine cellar to do... In reality, the situation is not funny. Because it shows what an enraged bureaucrat-psychopath in Poland can do to ordinary citizens, using state institutions for their revenge. (translated)
The Parliamentary Club Law and Justice is submitting a motion to dismiss the Ombudsman for Children's Rights, Monika Horny-Cieślak. The information revealed by @OficjalneZero is shocking. The police, guardian, and court did not see grounds for the immediate removal of children from their parents. Nevertheless, after the personal involvement of the Ombudsman for Children's Rights, two small children ended up in a children's home. The court ordered their immediate return to their parents and described the actions taken as grossly disproportionate, indicating that they may bear "clear signs of institutional violence." The Ombudsman for Children's Rights is supposed to protect children from harm, not use the authority of their office to pressure other institutions. This matter must be thoroughly explained. In our opinion, Monika Horny-Cieślak should no longer hold the position of Ombudsman for Children's Rights. Therefore, we are submitting a motion for her dismissal. (translated)
This is an absolute drama. It looks like the RPD acted like a vengeful aristocrat who thinks she can oppress her subjects because they looked at her the wrong way. It's good that other institutions reacted, but harm has still been done. - The Commissioner for Children's Rights Monika Horna-Cieślak was a witness to a street incident where a mother yanked and yelled at her child who was running into the street. And then she insulted the commissioner herself, who had pointed it out to her. - The RPD informed the police and the court, arguing for the necessity of taking the children away from these parents. - Neither the police, the court guardian, nor the court saw grounds for the immediate removal of the children and their placement in foster care. - Despite this, the children were sent to a care and educational facility (children's home) following a decision made by a police officer during an extraordinary meeting involving the RPD and the Commander of the Capital City Police. - The court ordered the immediate return of the children to their parents. In the justification, it indicated that actions against the family "may bear clear signs of institutional violence" and were "grossly disproportionate to the event that occurred." - The court had reservations about the personal involvement of the RPD, pointing out the possibility of using the authority of the office to push the thesis of the necessity of taking the children away. - One of the arguments in the case was two bottles of beer found in the apartment, which the court described as "completely misguided and even absurd." Such a scandalous (and clickable) affair will certainly be heated by all media and political activists regardless of party sympathies. (translated)
I am sending a letter today to the Ombudsman for Children with a request for clarification of the circumstances of this case. If this is true, then these findings are scandalous! More and more families are turning to my office, whose children are unjustly taken away by officials; it is alarming how the welfare of children is being so mistreated by institutions that are supposed to protect them in their mission! The use of the state apparatus to destroy a private family solely due to the offended pride of an official is further evidence of the absolute corruption of the centralized power system. State institutions have been producing people convinced of their own impunity for decades, as strange criteria for promotion and the lack of any accountability to the community solely promote arrogance. The systemic healing of the country requires the immediate introduction of direct disciplinary and financial accountability of officials to the citizens themselves, so that any attempt at similar private vendettas ends with an immediate wolf ticket and financial bankruptcy of the official. Jan Zielonka points out in his article that polarization in Poland leads to emotional reactions from voters, who instead of following their own interests, support their parties in a besieged political system, where the public space and institutions are gradually being politicized. (translated)

Radio ZET reveals a very interesting mechanism. The Chancellery of the President wanted to organize a summit at the Pilecki Institute in New York, but instead of reaching out to the Institute directly, it asked the Permanent Representation of the Republic of Poland to the UN to do it on its behalf. The Representation signed a contract for $35,000, but when asked by Dominika Długosz, it responds that it was not the organizer and points to the Chancellery of the President. Meanwhile, representatives of the Ministry of Culture do not understand why such a structure was used at all, as a state event organized by the Chancellery could have taken place at the Institute for free. There is only one problem: then the organizer would have to be the Chancellery, not a private foundation. State institutions provide a venue and bear the costs, while a private foundation sells sponsorship packages for tens of thousands of dollars at the event. Radio ZET describes a structure in which successive institutions point to each other. It does not look like a normal and transparent way of organizing an event involving the head of state. And it definitely requires clarification. (translated)
Before you is a troll in the rank of minister. Americans are postponing the visit of the Polish Minister of Defense to the Pentagon, and the minister in the Chancellery of the President comments: This is not good. He mocks the safety of the country, as it is clear that it is not the most important thing. The most important thing is NASISM. The Presidential Palace is building its own, alternative vision of foreign policy. Based almost exclusively on relations with Donald Trump, a man who can change his mind from one day to the next. Meanwhile, relations with stable European allies are treated as an unnecessary addition. This is a completely reversed hierarchy of interests. The safety of Poles cannot be based on what mood Donald Trump wakes up in on a given day. That’s why we have alliances, institutions, and lasting relations with partners. But for that, one needs to think in terms of the state, not OURS. (translated)

The party @__Lewica privatized the Voluntary Labor Corps. A report on Tvn24 showed that people were thrown out onto the street, sometimes with decades of experience; some were told to pack their things in boxes within 15 minutes and leave the institution. It was necessary to make room for party members. (translated)

NSA w Warszawie z 23.4.2008 r., II FSK 373/07, Legalis)." ,,W art. 18 pojęcie małżeństwa uzupełnione jest zwrotem definicyjnym, określającym małżeństwo "jako związek kobiety i mężczyzny" (zob. L. Garlicki, Artykuł 18, w: Garlicki, Konstytucja, t. 3, uw. 5, s. 2-3). #Polska #LGBTQ #Konstytucja
