Muitos eleitores da esquerda têm valores "de direita", mas votam na esquerda e apoiam políticas de esquerda porque aprenderam que aí está a virtude. A lapada de Mendonça em Gilmar é inteiramente baseada nos fatos e na lei. O relator do caso Master no STF reage à postagem política do decano no X, citando vedação de opinião sobre processo pendente de julgamento e de juízo depreciativo sobre despachos e votos (art.36, III, LC 35/1979). Aponta a contradição de Gilmar, que defendeu, semanas atrás, em embate com o próprio Mendonça, a publicidade de todas as decisões judiciais, mas “hoje se diz indignado com a publicidade dos autos”. Mostrando ter determinado apuração de vazamentos, Mendonça critica a indignação “seletiva” do decano com a “exposição alheia” (como a de Moraes, em decisão judicial), enquanto se cala sobre “a divulgação, na imprensa, de conversas de toda ordem que constrangem, coincidentemente, apenas ministros de entendimento diverso”, como Nunes Marques e Fux. Isto, logo após Gilmar, Zanin e Moraes terem requisitado e obtido da PF todo o conteúdo do celular de Vorcaro. Para Mendonça, “se há uso indevido na publicidade desta Corte”, ele está em “insinuações de que determinados conteúdos poderão ou não vir a público conforme o rumo de certos julgamentos”. Ao dizer o que jamais fez, Mendonça ainda remete sutilmente às mensagens de WhatsApp enviadas por Gilmar para Nunes Marques e Fux, já noticiadas pela imprensa. “O relator jamais ameaçou quem quer que seja de execração pública, nem se valeu de linguajar impróprio para que alguém se retirasse de julgamento. Tampouco transformou o plenário num palanque ou picadeiro, vociferando aos berros, para tentar mascarar com truculência ilações vazias e que carecem de qualquer fundamento jurídico minimamente aceitável. A divergência é legítima e própria de um tribunal colegiado. Ilegítima é a tentativa de constranger o julgador.” Por fim, Mendonça defende a “aprovação de um código de ética” do STF “que discipline de modo próprio a postura esperada do magistrado ao se pronunciar em qualquer ambiente, dentro e fora da Corte, inclusive no trato com os pares”. Critica a “verborragia” de Gilmar em momento que “reclama serenidade, respeito às instituições e apego às normas da República, à liturgia e ao decoro”. “O respeito não é somente aos pares, é sobretudo à instituição, afinal, como bem disse o Ministro Presidente [Fachin], o Supremo Tribunal Federal não pertence a nenhum de seus membros.” Não é, repito, como entende Gilmar, que atua como se fosse dono do STF e do país. #STF #Justiça #Direito
