I trochę przepadłem 😂 Zamiast przeczytać projekt i uzasadnienie, zacząłem sprawdzać liczby, raporty, na które się powołują, wskazane przez autorów orzeczenia, OSR, przepisy, które chcą uchylić, PPWR i w końcu właściwie całą konstrukcję tego pomysłu. Po kilku godzinach moja ocena jest gorsza niż przed rozpoczęciem analizy. To jest bubel, szanowny Panie Mentzen. Najbardziej zdumiewa mnie to, że projekt bardzo dokładnie wie, jak system kaucyjny zlikwidować. Tutaj nie ma większych wątpliwości - zgodnie z tytułem zamieszczanym w mediach społecznościowych. Uchylamy przepisy, obowiązki, rozliczenia, kontrolę i sankcje. Wygaszamy zezwolenia operatorów, kończymy funkcjonowanie systemu, rozliczamy to, co zostało. Dobrze. To co dokładnie zacznie funkcjonować następnego dnia w zamian, panie Mentzen? I tu nagle konkret gdzieś znika. W uzasadnieniu znajdziemy różne pomysły. ROP, sieć skupów, powrót PET i aluminium do systemu komunalnego. Tyle że uzasadnienie ustawy nie tworzy systemu prawnego. Można tam opisac dosłownie wszystko 🙂 Projekt bardzo konkretnie buduje mechanizm rozbiórki DRS, ale równie konkretnego mechanizmu, który miałby przejąć jego funkcje, już nie znalazłem. Potem zacząłem czytać o korzyściach dla zwykłej rodziny. 240–300 zł rocznie. Brzmi świetnie 💪 Tylko zaraz... skąd właściwie ta "oszczędność'? Z kaucji 🤦♂️ Kaucji, która z definicji jest zwrotna 😂 Jeżeli przez rok zapłacę 250 zł kaucji i po zwrocie opakowań odzyskam 250 zł, to nie straciłem 250 zł 🤷♂️ Mogę rozmawiać o pieniądzach czasowo zamrożonych. Oczywiście że można policzyć kaucje faktycznie nieodzyskane. To są uczciwe argumenty. Ale przedstawianie całej wartości pobieranych kaucji jako potencjalnej oszczędności gospodarstwa domowego jest już czymś zupełnie innym. Tym bardziej że w uzasadnieniu przeczytałem, iż ... "w większości przypadków" środki te mają być bezpowrotnie tracone z powodu problemów ze zwrotem 🤷♂️ No więc zacząłem szukać danych pokazujących, że większość kaucji rzeczywiście przepada. Nie znalazłem -zadnych. Ale prawdziwa zabawa zaczęła się przy odszkodowaniach. Autorzy sami piszą o potencjalnych roszczeniach operatorów rzędu 100–500 mln zł. Po czym uznają, że realna kwota zasądzonych odszkodowań wyniesie maksymalnie 50 mln 😵💫 Tu zatrzymałem się na dłużej, bo chciałem zobaczyć rachunek. 500 mln potencjalnej ekspozycji. 50 mln "realnie". Jak? Nie wiem 🤷♂️ Nie znalazłem modelu, wyliczenia prawdopodobieństwa ani rachunku prowadzącego do tych 50 mln. Za to znalazłem tłumaczenie, dlaczego zdaniem autorów operatorzy raczej nie powinni skutecznie dostać zbyt ..dużo Czyli najpierw państwo ustawą tworzy system. Przedsiębiorcy inwestują, kupują urządzenia, organizują logistykę i IT, zawierają umowy, uzyskują zezwolenia. Potem państwo mówi- dobra, jednak likwidujemy 🤷♂️ A w uzasadnieniu ustawy likwidującej system od razu zastanawiamy się, dlaczego roszczenia tych przedsiębiorców nie powinny być szczególnie skuteczne🤦♂️ Piękny komunikat na temat stabilności polskiego prawa i panowie z Konfederacji chcecie rządzic krajem ? Gratuluję poczucia himoru... Jeszcze ciekawsze są orzeczenia przywołane na poparcie tej argumentacji. Sprawdziłem je. Jedno z orzeczeń SA w Warszawie, VI ACa 636/13, dotyczyło sporu z zakresu zamówień publicznych z GDDKiA. Tak. To jest jeden z wyrokow przywołanych przy rozważaniach o sceptycznym podejściu sądów do roszczeń związanych z likwidacją zezwoleń, koncesji czy uprawnień. Drugie dotyczy zupełnie odmiennego stanu faktycznego odpowiedzialności Skarbu Państwa. A w sprawie IV CSK 26/16 Sąd Najwyższy uchylił zaskarżony wyrok i przekazał sprawę do ponownego rozpoznania.
