Sabri H. wurde zweieinhalb Jahre später vor der Jugendstrafkammer des Landgerichts Magdeburg wegen Körperverletzung mit Todesfolge zu zwei Jahren Haft auf Bewährung und 120 Arbeitsstunden verurteilt. Es ist der Beharrlichkeit des Vaters von Marcus zu verdanken, dass es überhaupt zu diesem Prozess kam. Denn zuerst wollte die Staatsanwaltschaft den Fall als Notwehrhandlung des Syrers abtun. Das, obwohl es Videoaufnahmen gibt, die zeigen, dass dem nicht so war. Am Ende stand dann das bemerkenswert milde Urteil gegen den 17-Jährigen. Der Persönlichkeitsschutz des jugendlichen Täters scheint hingegen bis heute oberste Priorität für die deutsche Justiz zu haben. Als ich im Frühjahr vergangenen Jahres das Urteil anforderte, wurde mir die Herausgabe verweigert mit der Begründung, dass „überwiegend schutzwürdige Interessen des zur Tatzeit jugendlichen Verurteilten zu beachten und zu schützen sind.“ Dies ist bis dato die einzige Verweigerung dieser Art bei über zweihundert Urteilsanfragen. #Justiz #Opferrecht #Gesellschaft
