The spokesperson for the President of the Republic of Poland, Rafał Leśkiewicz, said on Republic TV that the president had warned the government against unlawful actions towards the Constitutional Tribunal and attempts to forcibly take over this body. He announced that such actions would be met with a decisive reaction from the president, who—as he stated—has an obligation to respond to violations of the law. Leśkiewicz stated that the rule of law means adhering to the Constitution and laws, which the government and the prime minister are obliged to do. He accused the ruling party of looking for legal loopholes and alternative interpretations of regulations, adding that if they do not understand them, they should stop governing. He also said that individuals claiming to be judges of the Constitutional Tribunal are not, because they have not taken an oath before the president. In the case of some individuals, as he pointed out, there is a dispute before the Tribunal between the president and the speaker of the Sejm, arising from Article 189 of the Constitution. Leśkiewicz further claimed that Minister Berek does not meet the formal requirements to hold the position of a judge of the Tribunal, and Prime Minister Donald Tusk knows this or pretends not to know. He emphasized that the Polish people have the right to expect the highest qualifications from the Tribunal's judges. Regarding security and the blocking of illegal content on the internet, Leśkiewicz pointed to law enforcement and special services operating in Poland and to the anti-terrorism law, which he claimed would be in effect from 2024. He noted that the authorities on one hand talk about the need for a law to block illegal content, while on the other hand inform about their blocking. He claimed that the existing regulations already allow for the effective blocking of such content. He added that the government is responsible for ensuring security in Poland. In the matter of ambassadors, Leśkiewicz appealed for a solution to the problem so that Polish ambassadors could represent the country in their posts. He assessed that a conversation with Prime Minister Tusk is needed, not with Minister Sikorski, and said that the appointment of ambassadors in nearly 50 countries depends on the prime minister. #Praworządność #Konstytucja #Polska (translated)

The author of the post criticized Brudziński for referring to the democratically elected government as the "Tusk gang," accusing him of inconsistency with his declared defense of the rule of law and the Constitution. He reminded that — as he wrote — judges of the Constitutional Tribunal are elected by the Sejm based on Article 194, paragraph 1 of the Constitution of the Republic of Poland, and a change in the parliamentary majority does not take away these powers. The author also questioned the characterization of the Sejm's actions as an unlawful takeover of the Tribunal and the presentation of it as the last independent institution of justice, pointing to long-standing controversies regarding its composition, functioning, and independence. He accused Brudziński's group of treating the state as their own property. The commenter assessed that the dissemination of false or manipulated information and the presentation of lawful actions of the state as an assault on constitutional order should meet with a response from public opinion, as well as an assessment from the relevant authorities regarding potential legal responsibility. He added that freedom of speech and the right to criticize the government do not mean unlimited freedom to make false accusations. #Polska #konstytucja #praworządność (translated)

Max Hübner wrote that Zbigniew Bogucki calmly appeared at the briefing regarding the attempt to take over the Constitutional Tribunal by Tusk and Berek, which the author described as illegal. He claimed that Bogucki had been presenting legal arguments for 15 minutes indicating violations of the law and the possibility of holding both criminally responsible and imprisonment. Hübner used an offensive term towards them. https://t.co/nEj0eNGIOi #Polska #Prawo #TK (translated)

The author of the post questioned Duda about what specific actions and legal grounds justified his accusation of attempting to forcefully take control of the Constitutional Tribunal. He also asked whether the call for mobilization of members of the NSZZ "Solidarity" was meant to defend the competencies of the Sejm, the new judges, or the current personal arrangement in the Tribunal. He recalled that Article 1 of the law on trade unions defines the role of unions as representing and defending the rights and professional and social interests of employees. He emphasized that he did not question Duda's right to speak on constitutional matters or to organize peaceful demonstrations, but asked why he involved union structures in defending the current leadership of the Tribunal. Referring to the squabbles before the Tribunal, the author of the post asked whether Duda assessed the risk of escalation and anticipated security measures before the call for mobilization. He cited Article 57 of the Constitution and the obligations of organizers and leaders of assemblies arising from the law on assemblies. He asked whether Duda could guarantee that participants would not block entrances to institutions or hinder the legal actions of officials. The author stressed that merely declaring peaceful intentions, in his opinion, does not ensure safety, and asked whether Duda informed participants about the risk of confrontation. He also pointed out that "Solidarity" should not be, as he put it, the political backing of any party, and finally asked whether Duda would personally take responsibility for organizing the assembly and ensuring the safety of its participants. #TrybunałKonstytucyjny #Solidarność #PrawaCzłowieka (translated)

Max Hübner wrote that Karol Narocki questioned the actions of Donald Tusk, Waldemar Żurek, and Berek regarding the Constitutional Tribunal. According to Hübner, Narocki claimed that Berek is not a judge of the Tribunal, and the Tribunal operates with a composition in accordance with the Constitution. Hübner cited Narocki's argument that the oath to the president could not take place because he was receiving the president of Montenegro. Narocki also pointed out that Berek did not take an oath before the president, and the Tribunal still operates with a composition made up of individuals who have taken such an oath. Hübner added that the Venice Commission had confirmed the day before that the law requires the president's presence during the swearing-in. #TrybunałKonstytucyjny #Prawo #Konstytucja (translated)

The author wrote that the situation in Poland was heading towards anarchy and lawlessness.
