Dlaczego działania rządu są nielegalne (i to na tyle, że nawet minister Adam Bodnar się na nie nie zdecydował) z punktu widzenia 🇵🇱 prawa? 🔸️ Akademia Wymiaru sprawiedliwości podlega szczególnej regulacji ustawowej oraz obowiązują zabezpieczenia Trybunału Konstytucyjnego, którego kompetencje reguluje Konstytucja i odpowiednie przepisy. 🔸️ AWS to uczelnia służb państwowych nadzorowana przez ministra sprawiedliwości, jednak - co kluczowe w tej sprawie - art. 439 ust. 7 ustawy Prawo o szkolnictwie wyższym i nauce stanowi, że w sprawach powoływania i odwoływania rektora takiej uczelni stosuje się przepisy ustawy o Służbie Więziennej, a nie ogólne przepisy o szkolnictwie wyższym. 🔸️ Obowiązujący art. 66a ustawy o Służbie Więziennej przewiduje, że rektora powołuje Senat uczelni na pięcioletnią kadencję. Senat odwołuje go tylko w ściśle określonych przypadkach (długotrwała choroba lub prawomocne skazanie). Nie ma w prawie żadnej kompetencji ministra do odwołania rektora „za rażące lub uporczywe naruszenie prawa” (pretekst). 🔸️ Minister Żurek (przy pomocy ministra Berka? nie wiem, możliwe) zastosował art. 432 ust. 5 Prawa o szkolnictwie wyższym i nauce, który dotyczy uczelni „zwykłych”, a nie tej szczególnej regulacji. Dlatego próba przejęcia AWS odbywa się poza granicami prawa. 🔸️ Zabezpieczenie Trybunału Konstytucyjnego: 27 maja 2026 r. TK (sygn. K 11/26) wydał postanowienie zabezpieczające na wniosek grupy posłów. Wezwał ministra do: powstrzymania się od działań zmierzających do zawieszenia lub odwołania rektora, zawieszenia wszczętych postępowań administracyjnych do czasu ostatecznego rozstrzygnięcia sprawy. 🔸️ Ignorując decyzję TK, 29 maja br. minister ogłosił sobie, że on rektora odwołuje i już, a poza tym Żurkowi nie podoba się skład sędziowski, który orzekł w tej sprawie. W końcu to rząd wie lepiej, jacy sędziowie i jak powinni w TK orzekać, nawet jeśli nie ma do tego żadnej podstawy prawnej w obowiązujących w Polsce przepisach. #Polska #prawo #edukacja
