Als Tochter von Götz Kubitschek muß man aus der Gesellschaft ausgeschlossen werden — so sieht es jedenfalls das Sächsische Schulamt, das die Zulassung zum Referendariat verweigert und damit ein Berufsverbot faktisch auf der Grundlage der in den beiden deutschen Diktaturen praktizierten Sippenhaft ausspricht. Und so sieht es das Oberverwaltungsgericht. Denn die junge Frau und mehrfache Mutter hatte gar nicht einmal die Möglichkeit, irgendetwas falsch zu machen. Vorgeworfen wird ihr eine unterstellte falsche Gesinnung, ohne diese an eigenen Äußerungen belegen zu können. Begründet wird das damit, daß im Elternhaus Veranstaltungen des »Instituts für Staatspolitik« stattfanden. Aber auch die Vorwürfe gegenüber dem Institut sind hanebüchen: Weder wurde dort zur Gewalt aufgerufen, noch auf einen Systemumsturz hingearbeitet. Umständlich mußte eine weisungsgebundene Behörde den Vorwurf einer »Verfassungsfeindlichkeit« konstruieren, weil es von der Regierung so gewollt war. Daß selbst die Richter nicht die Absurdität des ganzen Vorgangs erkennen wollen, sollte jeden Rechtsstaatverteidiger mit größter Sorge erfüllen. Denn das, was hier geschieht, verstößt eindeutig gegen den Artikel 3 des Grundgesetzes. Dort heißt es ausdrücklich: »Niemand darf wegen seines Geschlechtes, seiner Abstammung, seiner Rasse, seiner Sprache, seiner Heimat und Herkunft, seines Glaubens, seiner religiösen oder politischen Anschauungen benachteiligt oder bevorzugt werden.
