Wild argued that the regulation concerned one facility in Poland, for whose design over 2 billion PLN had been issued or needed to be issued, taking into account the work already completed. The author linked the emergence of the provision to the Ministry of Infrastructure and wrote that oversight of the construction of CPK was exercised by the plenipotentiary, Deputy Minister Piotr Malepszak, who also supervised the ministry department that prepared the regulation. He added that the NeoCPK management could have requested an exemption from the minister, but he considered such a scenario unlikely. He suggested that the person responsible for the decisions should explain their effects to prosecutors. He also predicted that the regulations would prevent the construction of the northern frontage of Aleje Jerozolimskie above the tracks, as the new tunnel would have to be wider.
