Fałszywe zawiadomienie. We wrześniu 2025 roku prezes Trybunału Konstytucyjnego Bogdan Święczkowski złożył do prokuratury zawiadomienie o popełnieniu przestępstwa przez sędzię Magdalenę Wójcik z Sądu Okręgowego w Warszawie. Zarzucił jej umyślne przekroczenie uprawnień, bo wydała zgodę na zatrzymanie i doprowadzenie Zbigniewa Ziobry przed sejmową komisję śledczą ds. Pegasusa. Twierdził, że postanowienie sądu jest sprzeczne z orzeczeniem TK i bezprawne. Dodatkowo sugerował usiłowanie pozbawienia wolności przez policjantów Kilka dni później prezeska Sądu Okręgowego w Warszawie złożyła własne zawiadomienie do prokuratury, tym razem przeciwko Święczkowskiemu. Wskazała trzy możliwe czyny: przekroczenie uprawnień, znieważenie konstytucyjnego organu państwa oraz fałszywe oskarżenie. Sąd uznał, że prezes TK mógł wywierać presję na niezależny organ wymiaru sprawiedliwości i że zawiadomienie przeciwko sędzi Wójcik było fałszywe. Święczkowski wcześniej napisał też list do Komendanta Głównego Policji, sugerując, że wykonanie orzeczenia sądu może skutkować odpowiedzialnością karną funkcjonariuszy. Dla sądu powszechnego była to próba podważenia legalnego postanowienia i oskarżenia sędzi o przestępstwo, którego, według zawiadamiającego organu, nie popełniła. Sprawa nie zakończyła się jeszcze prawomocnym wyrokiem karnym wobec prezesa TK. Pokazuje jednak mechanizm: Święczkowski publicznie i formalnie zarzucił sędzi umyślne łamanie prawa, a sąd, którego sędzia została zaatakowana, ocenił to zawiadomienie jako nieprawdziwe.
